If Georgia Increases the Maximum Comp Rate, Do I Get the Benefit of the Increase?
Unfortunately no. Georgia law now provides for a maximum worker’s comp rate of $500 per week. This maximum was last changed in 2007, so it is possible that the legislature will take up this issue again in the next few years.
Your worker’s comp rate is set at the time your claim is made so if the maximum is increased, you will not get the benefit of the higher number.
Georgia used to provide for one of the lowest max comp rates in the country, but now we are about average for the United States.
